E-commerce Refund Complaint
E-commerce refunds, defective products, fake items, and return disputes

To complain about an e-commerce refund in India, first write to the platform's Grievance Officer — every e-commerce entity must appoint one under the Consumer Protection (E-Commerce) Rules, 2020, acknowledge your complaint within 48 hours and redress it within one month. If that fails, escalate to the National Consumer Helpline on 1800-11-4000, and then file at e-jagriti.gov.in before the District Consumer Commission. Filing is free where the consideration you paid was up to ₹5 lakh.
Key takeaways
- The Grievance Officer is a statutory role, not a support tier. Naming it in your email changes who reads the complaint and starts a 48-hour acknowledgement clock.
- One month is the outer limit for redressal under the E-Commerce Rules, 2020 — that is the date from which your escalation is properly founded.
- A marketplace cannot hide behind "the seller is responsible". It has its own duties on disclosure, grievance handling and unfair trade practices.
- For counterfeit or unsafe goods, the Central Consumer Protection Authority (CCPA) is a separate and additional route to the consumer commission.
- Consumer commission jurisdiction turns on the value of the consideration paid for the goods, not the compensation you claim.
iGuideline Summary
Under the Consumer Protection (E-Commerce) Rules, 2020, every e-commerce entity must appoint a Grievance Officer, display that officer's name and contact details on its site or app, acknowledge a consumer complaint within 48 hours and dispose of it within one month of receipt. It must also appoint a nodal person of contact resident in India under Rule 4, and publish its legal name, address, return, refund and exchange policy and seller details. Marketplace sellers carry their own grievance-officer obligation. Where goods are defective, unsafe, counterfeit or not as described, that is a deficiency in service or an unfair trade practice under the Consumer Protection Act, 2019 — a non-returnable label does not displace it, and the Central Consumer Protection Authority can act on the counterfeit separately from your own refund claim.

Frequently Asked Questions
My Amazon/Flipkart return was processed but refund is pending — what to do?
Wait for the platform's stated refund timeline (usually 5-10 business days). If exceeded, contact platform support with return reference. Then escalate to grievance officer. File on consumerhelpline.gov.in if unresolved.
I received a fake product — how do I complain?
Report it to the platform in writing with photographs, and file with the Grievance Officer. Report the counterfeit separately through consumerhelpline.gov.in so it reaches the Central Consumer Protection Authority, which can order recalls and penalties. Preserve the article itself — in a counterfeit case the product is the evidence, and returning it ends the claim.
E-commerce platform rejected my return — what are my rights?
If the product is defective or not as described, you have a right to return under Consumer Protection Act. Escalate to platform grievance officer, then NCH, then Consumer Forum if platform refuses.
How do I find the grievance officer of an e-commerce platform?
Under the Consumer Protection (E-Commerce) Rules, 2020, platforms must display the Grievance Officer's name and contact details prominently — usually under Help, Contact Us or a Grievance Redressal link in the footer. Take a dated screenshot when you find it, since these appointments change, and address your complaint to the officer by name and designation.
What proof do I need for a Consumer Forum complaint against e-commerce?
You need: invoice/order confirmation, evidence of defect, proof of return/complaint, company's response (or lack thereof), and any financial impact. GetNyay helps you organize this evidence.
What the Consumer Protection (E-Commerce) Rules, 2020 actually give you
Most people escalate an online refund by shouting louder in the same chat window. The Rules give you something better: named officers with statutory deadlines, and a set of disclosure obligations that a platform is very reluctant to be seen breaching in writing.
Every e-commerce entity — marketplace and inventory model alike — must appoint a Grievance Officer, display that officer's name and contact details prominently on its site or app, acknowledge every consumer complaint within 48 hours, and dispose of it within one month of receipt. Separately, under Rule 4 it must appoint a nodal person of contact, resident in India, responsible for compliance with the Act and the Rules. Sellers on a marketplace carry their own grievance-officer obligation on top of the platform's.
| Obligation | What it requires | Why it helps your complaint |
|---|---|---|
| Grievance Officer | Must be appointed, with name and contact displayed on the platform | Addressing the complaint to this officer moves it out of scripted first-line support |
| 48-hour acknowledgement | Receipt of every consumer complaint must be acknowledged within 48 hours | Silence past 48 hours is itself a documented breach you can point to |
| One-month redressal | The complaint must be disposed of within one month of receipt | Fixes the date from which your escalation to NCH or a commission is properly founded |
| Rule 4 nodal person | A compliance contact resident in India | Gives you a second named recipient when the grievance channel goes quiet |
| Mandatory disclosures | Legal name, address, customer care and grievance details, return/refund/exchange policy, and seller details | A missing or contradictory published policy undercuts the platform's own defence |
| Seller grievance officer | Marketplace sellers must appoint one too | Lets you address the seller and the platform in parallel rather than being bounced between them |

How to write an e-commerce refund complaint that gets escalated internally
Platform support is optimised to close tickets. A complaint that reads like a support message gets a support answer. A complaint that reads like the first page of a consumer case gets routed upward, because someone has to decide whether to defend it.
- 1Address it to the Grievance Officer by designation, and copy the general support address so the existing ticket stays linked.
- 2Open with identifiers, not narrative: order ID, item, order date, delivery date, amount paid, payment mode, return ID and every earlier ticket number with its date.
- 3State the facts in dated sequence, one line per event, with no adjectives. Dates are what make the delay self-evident.
- 4Cite the obligation you say has been breached — the 48-hour acknowledgement, the one-month redressal window, or the platform's own published return policy, quoted verbatim.
- 5State the relief precisely: the exact rupee amount, the mode of refund you require (original payment method, not store credit), and the date by which you require it.
- 6Give a deadline — 15 days is the convention — and say what you will do next: National Consumer Helpline, then a complaint before the District Consumer Commission.
- 7List your enclosures and attach them as one labelled PDF. Scattered screenshots are routinely "not received".
Where money is due, a wallet balance or coupon is a settlement offer, not compliance. Say in writing that you decline the credit and require the refund in the original mode of payment. Accepting credit makes the later consumer complaint much harder to argue.
Refund shows as processed but the money has not arrived
This is the most common e-commerce complaint in India and it usually has one of three causes: the platform has not actually initiated the refund; it initiated it to a wallet rather than the source account; or it initiated it to the card or bank and the credit is in transit.
The way to separate them is to ask for the ARN — the Acquirer Reference Number, sometimes called the RRN or UTR — for the refund transaction. It is a unique reference generated when a refund is actually pushed to the payment network. A platform that has genuinely refunded can produce it in seconds. A platform that cannot produce one has not refunded, whatever the app screen says.
- 1Ask the platform, in writing, for the ARN/RRN/UTR of the refund and the exact date it was initiated.
- 2If they give one, take it to your bank or card issuer and ask them to trace the credit against that reference.
- 3If they cannot give one, say so in your complaint: "no reference number has been provided, and I therefore treat the refund as not initiated".
- 4Where the refund was made to a platform wallet without your consent, demand reversal to the original payment method and cite the published refund policy.
- 5Keep a bank statement extract covering the full period, showing the original debit and the absence of any credit. That single document does most of the work at the consumer commission.
That is a failed payment, not a refund dispute, and a different rule applies. Under the RBI Turn Around Time framework, a card or UPI-to-merchant debit that does not complete must be auto-reversed within T+5 days, and a failed UPI person-to-person transfer within T+1 day, with ₹100 per day payable for delay beyond it. Raise that with your bank, not with the platform.
Return rejected, or the return window closed before you could act
Platforms reject returns on three grounds in practice: the return window had closed, the product was found "used", or the item is in a non-returnable category. Each is answerable, but only with the right evidence, and the evidence has to exist before the dispute starts.
The strongest single piece of evidence in an Indian e-commerce dispute is a continuous, unedited unboxing video that starts before the outer packaging is opened and shows the shipping label and the seal. It defeats the "damaged in your possession" defence almost outright. If a delivery is visibly tampered with, open it in front of the delivery agent, or refuse it and record the refusal.
- A non-returnable label cannot override a statutory right where the goods are defective, unsafe, or not as described — that is a deficiency, not a change of mind.
- Where the defect was only discoverable on use, the clock realistically runs from discovery; say so expressly rather than conceding the window.
- Ask the platform to produce its quality-check report if a return was rejected as "used" or "not matching". A rejection with no report is a conclusion, not evidence.
- Keep the outer packaging, the shipping label and the invoice until the dispute closes.
- Where the listing description differs from what arrived, screenshot the live listing immediately — listings are edited, and yours is the only copy that will survive.
Counterfeit, unsafe or misdescribed goods: the CCPA route
A refund puts you back where you started. It does nothing about a seller who is shipping counterfeits at scale. The Consumer Protection Act, 2019 created the Central Consumer Protection Authority (CCPA) precisely for that class of harm — unfair trade practices, misleading advertisements, and goods that are unsafe or not what they claim to be.
The CCPA can order recall, order refunds to consumers as a class, discontinue misleading advertisements and impose penalties. It is not a substitute for your individual complaint; it runs in parallel, and it is worth taking ten minutes over because it is the route that changes seller behaviour.
- File your individual claim at e-jagriti.gov.in for your own refund and compensation.
- Report the counterfeit or unsafe product separately through the National Consumer Helpline at consumerhelpline.gov.in, which feeds the CCPA.
- Preserve the physical product. In a counterfeit case the article itself is the evidence, and disposing of it ends the claim.
- Photograph brand markings, serial numbers, holograms and packaging against the genuine article where you can.
- Where the seller is a third party on a marketplace, name both the seller and the platform.
Which commission hears an online shopping case, and what it costs
Jurisdiction is fixed by the value of the consideration paid for the goods or services — the price of the item — and not by the compensation figure in your prayer. Self-filed complaints regularly go to the wrong commission because the claimant adds a large mental-agony figure and assumes that decides the forum. It does not.
For almost every online shopping dispute this means the District Commission, in the district where you reside or work, and it means no filing fee.
| Value of consideration paid | Commission | Filing fee |
|---|---|---|
| Up to ₹5 lakh | District Commission | Nil |
| Above ₹5 lakh and up to ₹10 lakh | District Commission | ₹200 |
| Above ₹10 lakh and up to ₹20 lakh | District Commission | ₹400 |
| Above ₹20 lakh and up to ₹50 lakh | District Commission | ₹1,000 |
| Above ₹50 lakh and up to ₹2 crore | State Commission | As notified |
| Above ₹2 crore | National Commission | As notified |
Pecuniary limits per the Consumer Protection (Jurisdiction…) Rules, 2021; fee slabs per the Consumer Protection (Consumer Disputes Redressal Commissions) Rules, 2020 as amended. Confirm on e-jagriti.gov.in before filing. A consumer may file where they reside or personally work for gain — you do not have to travel to the platform's head office.
A consumer complaint must be filed within two years of the cause of action. Delay can be condoned for sufficient cause, but you must apply for condonation and explain it. Every month you spend re-opening support tickets is a month off that clock — escalate on a schedule, not on hope.
What you can actually claim beyond the refund
A prayer clause that asks only for the refund gets you, at best, the refund — which you were entitled to anyway. Consumer commissions routinely award more, but only where it is asked for and quantified.
- The refund or replacement value itself, stated as an exact figure.
- Interest on that amount from the date it fell due until payment.
- Compensation for deficiency in service, mental agony and harassment — discretionary, so support it with what the delay actually cost you.
- Consequential loss you can document: a replacement bought at a higher price, a missed occasion, wasted courier charges.
- Litigation costs, including what it cost you to prepare and file.
- Where the conduct is egregious or repeated, punitive damages and a direction to discontinue the practice.
Write "₹1,200 paid for a replacement purchased on 4 July, invoice at Annexure D" rather than "I suffered loss". A commission can only award what it can identify on the record.
Worked examples
Example 1: Refund marked processed, no credit after 40 days
- Item value
- ₹18,499
- Return picked up
- 12 June
- App status
- "Refund processed" on 15 June
- Bank credit
- None as at 25 July
- ARN supplied by platform
- None
- Payment mode
- Credit card
- 1.The complaint was raised on 16 June, so the 48-hour acknowledgement and the one-month redressal window under the E-Commerce Rules, 2020 both expired — on 18 June and 16 July respectively.
- 2.No ARN, RRN or UTR was ever supplied, so there is no evidence the refund was pushed to the payment network at all.
- 3.The bank statement for 12 June to 25 July shows the original debit and no corresponding credit, which is the document that decides the point.
- 4.Escalation is therefore properly founded from 16 July, and the National Consumer Helpline step can be taken immediately.
- 5.Consideration paid is ₹18,499, well under ₹5 lakh, so the District Commission has jurisdiction and the filing fee is nil.
Write to the Grievance Officer demanding ₹18,499 to the original card within 15 days, and requiring the ARN if the platform maintains the refund was made. On expiry, file at consumerhelpline.gov.in, then at e-jagriti.gov.in before the District Commission, claiming the refund, interest, compensation and costs.
Example 2: Return rejected as "product used" after an unboxing video
- Item
- Consumer electronics
- Item value
- ₹7,299
- Return raised
- Day 3 of a 7-day window
- Rejection reason
- "Quality check failed — product used"
- Quality-check report
- Not provided
- Evidence held
- Continuous unboxing video showing sealed carton and defect on first power-on
- 1.The return was raised inside the published window, so the window is not in issue and the platform cannot rely on it.
- 2.The rejection asserts prior use. The unboxing video shows an intact seal and the defect appearing on first power-on, which contradicts it directly.
- 3.A rejection with no quality-check report is a conclusion without evidence — demand the report in writing, and record the refusal if none comes.
- 4.A defective good is a deficiency, so a non-returnable or "no questions asked" category label does not defeat the claim.
- 5.Consideration paid is ₹7,299, so this is a District Commission matter with a nil filing fee.
Demand the quality-check report and a refund of ₹7,299 to the original payment method within 15 days, attaching the unboxing video and the listing screenshot. If the platform holds its position, file before the District Commission relying on the video as the primary evidence.
Example 3: Counterfeit branded item shipped by a marketplace seller
- Item
- Branded accessory
- Item value
- ₹4,150
- Sold by
- Third-party seller on a marketplace
- Issue
- Serial number does not exist in the brand's records
- Brand confirmation
- Email from brand support confirming counterfeit
- Platform response
- "Contact the seller"
- 1.Sale of a counterfeit is an unfair trade practice under the Consumer Protection Act, 2019, not merely a return dispute.
- 2.The brand's written confirmation is expert evidence on authenticity and should be the lead annexure.
- 3.The marketplace has its own statutory duties on disclosure and grievance redressal, so "contact the seller" does not discharge it — name both as opposite parties.
- 4.The physical article must be preserved. In a counterfeit case it is the evidence, and returning it to the seller destroys the claim.
- 5.Report separately through consumerhelpline.gov.in so the matter reaches the CCPA, which can act against the seller beyond your individual refund.
Claim ₹4,150 as refund plus compensation for having been sold a counterfeit, name both the seller and the marketplace, and file the CCPA report in parallel. Retain the article, its packaging and the brand's email until the case closes.
