Terms of Service

By accessing or using GetNyay at https://getnyay.in (the “Platform”) or registering an account, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy.

If you do not agree to these Terms in their entirety, you must not use the Platform.

These Terms are entered into between you (“User”) and Deepak Middha, a Chartered Accountant, who publishes and operates GetNyay (“GetNyay,” “we,” “our,” or “us”).

GetNyay is a free self-help legal document and information platform for India. What is on the Platform today:

• Consumer complaint drafting — guided, partly AI-assisted tools that assemble a complaint letter from details you enter.
• Legal notices — money recovery, unpaid salary and invoices, security deposit, cheque bounce, eviction and tenancy, builder delay, defamation and similar.
• Document formats and templates — affidavits, gift deeds, sale agreements, partition and recovery notices, RERA and consumer complaint formats, bilingual rent agreements.
• Letters and applications — leave applications, NOCs, undertakings, authority and consent letters, declarations, bonafide and character certificate applications, and HR letters.
• Divorce and family document tools — mutual consent and contested procedure guides, maintenance, property rights, annulment, notice formats, and an affidavit wizard.
• Calculators — limitation periods, consumer court fee and jurisdiction, banking ombudsman eligibility, cheque bounce timelines, maintenance.
• A grievance officer directory — nodal and grievance contacts compiled from official published sources, each showing when it was last verified.
• Evidence checklists, escalation guidance, and informational articles and guides on Indian consumer and civil procedure.
• Word (.docx) and PDF downloads, email-ready formats and printable copies of anything you generate.

The Platform provides drafting assistance and informational tools. It does not file complaints, represent users, negotiate on behalf of users, or guarantee any resolution or outcome.

For significant legal disputes, complex legal matters, or situations involving substantial sums of money or legal risk, you should consult a qualified legal professional (advocate or solicitor). GetNyay is designed for straightforward consumer grievance drafting and is not a substitute for professional legal counsel.

You are entirely responsible for reviewing, verifying, and correcting the complaint draft before submitting it to any regulator, company, or authority.

To use the Platform, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement

An account is not required. You may use every tool on the Platform as a guest, and most people do. Section 6 sets out what an account adds.

If you do choose to create one, you must additionally:

• Register with accurate and complete account information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorised access to your account

You are responsible for all activity that occurs under your account. You may not share your account with others or use the Platform on behalf of another person without their express written consent.

We reserve the right to suspend or terminate accounts that provide false registration information or violate these Terms.

GetNyay is free to use. Every complaint letter, legal notice, template, checklist, calculator, and escalation guide on the Platform is provided at no charge.

• There is no payment step anywhere in the consumer document flow.
• You receive the complete document — not a partial preview — including the Word (.docx) and PDF downloads, with no watermark.
• No account, subscription, or credit card is required to generate or download a document.
• We do not collect card details, and we do not charge you at any point for the consumer features described in these Terms.

GetNyay’s currently available tools, generators and templates are free to use. No payment is required.

GetNyay may introduce optional paid products or services in the future. If that happens, pricing and applicable terms will be clearly disclosed before a user purchases or subscribes.

You do not need an account to draft or download a document. Signing in exists only so that you can return to drafts you created earlier and manage them from your dashboard.

• You may use the Platform entirely as a guest.
• If you do create an account, you are responsible for keeping your login credentials secure.
• You may request deletion of your account and associated drafts at any time by emailing team@getnyay.in.

GetNyay’s currently available tools, generators and templates are free to use, so no refund arises. If you believe you have been charged for anything on GetNyay, or by anyone claiming to represent GetNyay, contact us immediately at team@getnyay.in.

When using the Platform, you agree to:

• Provide accurate and truthful information in your complaint drafts
• Review and verify all AI-generated content before submitting it to any party
• Verify all regulator contact details, addresses, and filing procedures from official government sources before use
• Keep your account credentials confidential
• Not use the Platform to file frivolous, malicious, or knowingly false complaints
• Not upload files containing malware, viruses, or malicious code
• Not attempt to circumvent, hack, or reverse-engineer any part of the Platform
• Comply with all applicable laws including the Indian Consumer Protection Act 2019 when submitting complaints

The following are strictly prohibited on the Platform:

• Filing or drafting complaints that are knowingly false, fraudulent, or intended to harass a third party
• Impersonating another person or creating a complaint on behalf of someone else without their consent
• Uploading content that is defamatory, obscene, threatening, or otherwise unlawful
• Attempting to gain unauthorised access to other users' accounts or data
• Using automated tools, bots, or scrapers to access or extract content from the Platform
• Reselling, sublicensing, or commercially redistributing AI-generated complaint content
• Using the Platform to plan, facilitate, or conceal any unlawful activity
• Interfering with or disrupting the Platform's infrastructure or servers

Violation of these prohibitions may result in immediate account suspension, termination, and possible legal action. See our Acceptable Use Policy for details.

Our property: The Platform, including its design, code, complaint templates, AI prompts, rule-based logic, and educational content, is the intellectual property of Deepak Middha, the publisher of GetNyay. You may not copy, reproduce, or commercially use any part of the Platform without our prior written consent.

Your content: The complaint information you enter (the facts of your grievance) remains your own. We claim no ownership over the factual content of your complaint.

Generated content licence: We grant you a limited, non-exclusive, non-transferable, personal-use licence to use the generated complaint letter for the purpose of submitting it as a consumer grievance on your own behalf. Commercial use, resale, or redistribution of generated content is not permitted.

• AI models do not have legal training and do not interpret law
• Regulator names, procedures, timelines, and contact details generated by AI must be independently verified
• AI-generated complaint letters are tools to assist you — they are not certified legal documents
• We do not warrant the accuracy, completeness, or fitness for purpose of any AI-generated content

The Platform integrates with third-party services including Supabase (database), Vercel (hosting), and AI providers. We are not responsible for the conduct, policies, or availability of these third-party services.

Links to external regulators, government websites, or other resources on the Platform are provided for informational purposes only. We do not endorse or guarantee the accuracy of any external website content. All external links should be independently verified against official sources.

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING:

• Merchantability or fitness for a particular purpose
• Accuracy, completeness, or reliability of AI-generated content
• Uninterrupted, error-free, or secure access to the Platform
• That any complaint drafted on the Platform will achieve any particular result
• That regulator procedures, timelines, or contact information on the Platform is current or accurate

To the maximum extent permitted by applicable law, Deepak Middha, the publisher of GetNyay, and his agents and successors shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of income, revenue, profits, or business opportunities arising from use of the Platform
• Any damages resulting from reliance on AI-generated complaint content
• Any outcome (or lack thereof) from filing a complaint drafted on the Platform
• Any third-party conduct, including the conduct of companies you file complaints against

The Platform is provided free of charge and we take no payment from users, so no fee has been paid that a liability could be measured against. To the extent a monetary cap is required, our total aggregate liability in connection with any claim arising out of or relating to the Platform is limited to ₹10,000.

Some jurisdictions do not allow the exclusion of implied warranties or the limitation of liability for certain types of damages. The above limitations apply to the extent permitted by applicable law.

You agree to indemnify, defend, and hold harmless Deepak Middha, the publisher of GetNyay, and his officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Platform in violation of these Terms
• Any complaint you submit to a third party using content drafted on this Platform
• Any false, inaccurate, or fraudulent information you provide on the Platform
• Your violation of any applicable law or regulation
• Your infringement of any third-party rights

These Terms are governed by the laws of the State of Illinois, United States of America, without regard to its conflict-of-law provisions.

For users in India, nothing in these Terms is intended to limit your rights under the Indian Consumer Protection Act 2019 or other mandatory consumer protection statutes applicable in your jurisdiction to the extent such rights cannot be contractually waived.

Informal resolution first: Before initiating any formal proceeding, you agree to contact us at team@getnyay.in and attempt to resolve the dispute informally. We will respond within 15 business days.

Binding arbitration: If the dispute is not resolved informally within 30 days, either party may initiate binding arbitration under the rules of the American Arbitration Association, conducted in Cook County, Illinois, USA. Arbitration shall be conducted in English.

Class action waiver: You agree to resolve disputes with us only on an individual basis and not as part of a class, consolidated, or representative action.

Exception: Either party may seek emergency injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm.

Your right to terminate: You may close your account at any time by contacting team@getnyay.in, and you may simply stop using the Platform at any time without doing anything — there is nothing to cancel and nothing to pay.

Our right to terminate: We may suspend or terminate your access to the Platform at any time, with or without notice, if we determine (in our sole discretion) that you have violated these Terms, engaged in fraudulent activity, or where continued access poses a legal or security risk.

Effect of termination: Upon termination, your right to access the Platform ceases immediately. Sections 3, 10, 13, 14, 15, 16, 17, and 19 survive termination.

Modifications

We reserve the right to modify these Terms at any time. We will provide at least 14 days’ notice by email or Platform notification for material changes. Continued use after the effective date of the revised Terms constitutes acceptance.

Force Majeure

We are not liable for any failure to perform our obligations where such failure results from causes beyond our reasonable control, including but not limited to natural disasters, acts of government, cyberattacks, or cloud provider outages.

Entire Agreement

These Terms, together with the Privacy Policy and other policies linked herein, constitute the entire agreement between you and GetNyay with respect to the Platform and supersede all prior agreements.

Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
