Terms of Service

By accessing or using GetNyay at https://getnyay.in (the “Platform”), registering an account, or paying for any service, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy.

If you do not agree to these Terms in their entirety, you must not use the Platform.

These Terms are entered into between you (“User”) and Wealth Building Academy LLC, an Illinois limited liability company (“GetNyay,” “we,” “our,” or “us”).

GetNyay is a self-help consumer complaint drafting platform. We provide:

• Guided, AI-assisted tools to help you draft consumer complaint letters
• Rule-based and AI-generated complaint templates tailored to Indian consumer protection processes
• Educational summaries of consumer grievance escalation pathways (for informational purposes only)
• Evidence checklists and escalation guidance as drafting aids
• PDF downloads, email-ready formats, and printable copies of your drafted complaint letters

The Platform provides drafting assistance and informational tools. It does not file complaints, represent users, negotiate on behalf of users, or guarantee any resolution or outcome.

For significant legal disputes, complex legal matters, or situations involving substantial sums of money or legal risk, you should consult a qualified legal professional (advocate or solicitor). GetNyay is designed for straightforward consumer grievance drafting and is not a substitute for professional legal counsel.

You are entirely responsible for reviewing, verifying, and correcting the complaint draft before submitting it to any regulator, company, or authority.

To use the Platform, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Register with accurate and complete account information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorised access to your account

You are responsible for all activity that occurs under your account. You may not share your account with others or use the Platform on behalf of another person without their express written consent.

We reserve the right to suspend or terminate accounts that provide false registration information or violate these Terms.

Free features: You may generate a complaint preview and view the first portion of your draft letter at no cost.

Paid unlock: The full complaint letter, PDF download, email-ready copy, complete evidence checklist, and escalation guide are unlocked by a one-time payment of ₹99 per complaint.

• All payments are processed by Stripe, Inc. — a PCI-DSS Level 1 compliant payment processor.
• We do not store your card number, CVV, or full payment details. Stripe handles all card data.
• Payment in full is required before unlocked content is delivered.
• Prices are displayed in Indian Rupees (INR). Stripe handles any currency conversion.
• We reserve the right to change pricing with reasonable notice.

The Attorney Max subscription is a recurring paid plan that provides attorneys with access to the attorney dashboard, client management, document generation, and template library features.

6.1 Free Trial

• New attorney registrations are eligible for a 14-day free trial of the Attorney Max plan.
• No credit card is required to start the free trial.
• The free trial begins on the date of account confirmation and ends automatically after 14 days.
• After the trial period, continued access to attorney premium features requires upgrading to a paid plan.
• Each attorney account is eligible for one free trial only. Creating multiple accounts to extend trial access is prohibited.

6.2 Subscription Plans & Billing

• Subscription plans and pricing are displayed at getnyay.in/attorney and getnyay.in/pricing.
• Subscriptions are billed on a monthly or annual cycle as selected at the time of purchase.
• All subscription payments are processed by Stripe, Inc. — a PCI-DSS Level 1 compliant payment processor.
• Subscriptions automatically renew at the end of each billing cycle unless cancelled before the renewal date.
• We will send a renewal reminder email at least 7 days before the next billing date.
• We reserve the right to change subscription pricing with 30 days' notice to existing subscribers.

6.3 Cancellation

• You may cancel your subscription at any time through your attorney dashboard or by emailing support@getnyay.in.
• Cancellation takes effect at the end of the current billing period. You retain access to paid features until the period ends.
• After cancellation, your account enters a read-only state. Your documents and client records remain accessible for 30 days for download before permanent deletion.
• We do not provide pro-rated refunds for partial subscription periods, except as required by applicable law.

6.4 Account Suspension & Termination by Us

• We may suspend an attorney account if a subscription payment fails. We will attempt to notify you and allow 7 days to resolve the payment before suspension.
• We may terminate an attorney account for violation of these Terms, breach of the Attorney Responsibilities section below, or fraud.
• Upon termination for cause, we are not obligated to provide a refund for any prepaid subscription period.

Because the Platform delivers digital content immediately upon payment, refunds are generally not provided after a successful payment and content delivery.

For one-time complaint unlocks (₹99 per complaint):

• If you were charged but content was not unlocked due to a technical error, you are eligible for a refund or manual unlock — contact payments@getnyay.in with your Stripe session ID.
• If you were charged twice for the same complaint (duplicate charge), you are eligible for a full refund of the duplicate.
• Change of mind after content is delivered does not entitle you to a refund.
• Dissatisfaction with complaint outcome (which we cannot control) does not entitle you to a refund.

For Attorney Max subscriptions:

• Free trial subscribers are not charged and therefore no refund applies during the trial period.
• We do not provide pro-rated refunds for partial subscription months after the billing date.
• If you are charged for a renewal after you believed you had cancelled, contact support@getnyay.in within 7 days of the charge for a refund review.
• Refunds for subscription payments are evaluated on a case-by-case basis and are not guaranteed.

When using the Platform, you agree to:

• Provide accurate and truthful information in your complaint drafts
• Review and verify all AI-generated content before submitting it to any party
• Verify all regulator contact details, addresses, and filing procedures from official government sources before use
• Keep your account credentials confidential
• Not use the Platform to file frivolous, malicious, or knowingly false complaints
• Not upload files containing malware, viruses, or malicious code
• Not attempt to circumvent, hack, or reverse-engineer any part of the Platform
• Comply with all applicable laws including the Indian Consumer Protection Act 2019 when submitting complaints

9.1 Professional Responsibility

• You are solely responsible for the final legal documents and communications you produce for or on behalf of clients using this Platform.
• AI-generated content generated on this Platform is a drafting aid only. You must review, verify, and correct all AI-generated content before it is shared with or used on behalf of any client.
• GetNyay does not provide legal advice. Using this Platform does not discharge your professional obligation to apply independent legal judgement to client matters.
• You remain bound by the professional conduct rules of the Bar Council or regulatory body governing your legal practice.

9.2 Client Data Handling

• You are the data controller for any client data you enter into the Platform. GetNyay is the data processor, processing client data on your instructions solely to provide the attorney dashboard service.
• You represent that you have the necessary authority and client consent (where required) to enter client personal data into a third-party technology platform.
• You must not enter client data that is more sensitive than necessary for the purpose of generating the relevant legal document or managing the relevant matter.
• You must maintain appropriate security for your attorney account credentials to prevent unauthorised access to client data stored on the Platform.
• You are responsible for complying with any applicable data protection laws governing your handling of client data, including the IT Act 2000, DPDP Act (India), and applicable bar council rules on client confidentiality.

9.3 Confidentiality

• You must treat client information entered into the Platform as confidential and not share it beyond what is necessary for the service.
• You must notify affected clients if you become aware of any unauthorised access to client data in your attorney account.
• GetNyay will process client data only as instructed and will not share client data with third parties except as necessary to provide the service (e.g., AI processing for document generation).

9.4 Account Sharing Prohibited

Attorney Max accounts are for individual use only. You may not share your login credentials with other attorneys, paralegals, or staff. Each user who requires access must have their own account.

The following are strictly prohibited on the Platform:

• Filing or drafting complaints that are knowingly false, fraudulent, or intended to harass a third party
• Impersonating another person or creating a complaint on behalf of someone else without their consent
• Uploading content that is defamatory, obscene, threatening, or otherwise unlawful
• Attempting to gain unauthorised access to other users' accounts or data
• Using automated tools, bots, or scrapers to access or extract content from the Platform
• Reselling, sublicensing, or commercially redistributing AI-generated complaint content
• Using the Platform to plan, facilitate, or conceal any unlawful activity
• Interfering with or disrupting the Platform's infrastructure or servers

Violation of these prohibitions may result in immediate account suspension, termination, and possible legal action. See our Acceptable Use Policy for details.

Our property: The Platform, including its design, code, complaint templates, AI prompts, rule-based logic, and educational content, is the intellectual property of Wealth Building Academy LLC. You may not copy, reproduce, or commercially use any part of the Platform without our prior written consent.

Your content: The complaint information you enter (the facts of your grievance) remains your own. We claim no ownership over the factual content of your complaint.

Generated content licence: We grant you a limited, non-exclusive, non-transferable, personal-use licence to use the generated complaint letter for the purpose of submitting it as a consumer grievance on your own behalf. Commercial use, resale, or redistribution of generated content is not permitted.

• AI models do not have legal training and do not interpret law
• Regulator names, procedures, timelines, and contact details generated by AI must be independently verified
• AI-generated complaint letters are tools to assist you — they are not certified legal documents
• We do not warrant the accuracy, completeness, or fitness for purpose of any AI-generated content

The Platform integrates with third-party services including Stripe (payments), Supabase (database), Vercel (hosting), and AI providers. We are not responsible for the conduct, policies, or availability of these third-party services.

Links to external regulators, government websites, or other resources on the Platform are provided for informational purposes only. We do not endorse or guarantee the accuracy of any external website content. All external links should be independently verified against official sources.

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING:

• Merchantability or fitness for a particular purpose
• Accuracy, completeness, or reliability of AI-generated content
• Uninterrupted, error-free, or secure access to the Platform
• That any complaint drafted on the Platform will achieve any particular result
• That regulator procedures, timelines, or contact information on the Platform is current or accurate

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WEALTH BUILDING ACADEMY LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of income, revenue, profits, or business opportunities arising from use of the Platform
• Any damages resulting from reliance on AI-generated complaint content
• Any outcome (or lack thereof) from filing a complaint drafted on the Platform
• Any third-party conduct, including the conduct of companies you file complaints against

Our total aggregate liability to you in connection with any claim arising out of or relating to the Platform is limited to the greater of: (a) the amount you actually paid for the specific transaction giving rise to the claim, or (b) the total subscription fees you paid to us in the 3 months preceding the claim — in no event exceeding ₹10,000.

Some jurisdictions do not allow the exclusion of implied warranties or the limitation of liability for certain types of damages. The above limitations apply to the extent permitted by applicable law.

You agree to indemnify, defend, and hold harmless Wealth Building Academy LLC and its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Platform in violation of these Terms
• Any complaint you submit to a third party using content drafted on this Platform
• Any false, inaccurate, or fraudulent information you provide on the Platform
• Your violation of any applicable law or regulation
• Your infringement of any third-party rights

These Terms are governed by the laws of the State of Illinois, United States of America, without regard to its conflict-of-law provisions.

For users in India, nothing in these Terms is intended to limit your rights under the Indian Consumer Protection Act 2019 or other mandatory consumer protection statutes applicable in your jurisdiction to the extent such rights cannot be contractually waived.

Informal resolution first: Before initiating any formal proceeding, you agree to contact us at legal@getnyay.in and attempt to resolve the dispute informally. We will respond within 15 business days.

Binding arbitration: If the dispute is not resolved informally within 30 days, either party may initiate binding arbitration under the rules of the American Arbitration Association, conducted in Cook County, Illinois, USA. Arbitration shall be conducted in English.

Class action waiver: You agree to resolve disputes with us only on an individual basis and not as part of a class, consolidated, or representative action.

Exception: Either party may seek emergency injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm.

Your right to terminate: You may close your account at any time by contacting support@getnyay.in. Termination does not entitle you to a refund of paid amounts except where stated in the Refund Policy.

Our right to terminate: We may suspend or terminate your access to the Platform at any time, with or without notice, if we determine (in our sole discretion) that you have violated these Terms, engaged in fraudulent activity, or where continued access poses a legal or security risk.

Effect of termination: Upon termination, your right to access the Platform ceases immediately. Sections 3, 11, 14, 15, 16, 17, 18, and 20 survive termination.

Modifications

We reserve the right to modify these Terms at any time. We will provide at least 14 days’ notice by email or Platform notification for material changes. Continued use after the effective date of the revised Terms constitutes acceptance.

Force Majeure

We are not liable for any failure to perform our obligations where such failure results from causes beyond our reasonable control, including but not limited to natural disasters, acts of government, cyberattacks, or cloud provider outages.

Entire Agreement

These Terms, together with the Privacy Policy and other policies linked herein, constitute the entire agreement between you and GetNyay with respect to the Platform and supersede all prior agreements.

Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
